These Terms of Sale (“Terms”) govern your purchase of products and services from SEG Stores LLC d/b/a The Game Bunker (“we,” “us,” or “our”). By placing an order through our website at www.thegamebunker.com (“Site”), you agree to be bound by these Terms.

If you do not agree, do not place an order.

1. Order Acceptance

Your order is an offer to purchase. We may accept or reject any order at our sole discretion, including after order confirmation, in the event of error, product unavailability, or suspected fraud.

Once accepted, orders are final subject to our Return Policy and any applicable brand-specific policies.

2. Pricing, Payment & Errors

Prices are shown in U.S. Dollars and are subject to change without notice.
We reserve the right to correct pricing mistakes, availability errors, and misprints — including after an order has been submitted.

Payment must be received before shipment. By submitting payment, you confirm:

  • You are authorized to use the payment method
  • All provided information is accurate
  • You will pay all charges including taxes and shipping

3. Shipping, Delivery & Risk of Loss

Many products ship via freight due to size and weight. By purchasing, you understand and agree:

  • You are responsible for any freight-related charges*, including liftgate, missed delivery, re-delivery, storage, or rerouting fees.
  • Title and risk of loss transfer to you once the carrier accepts the product for delivery.
  • Delivery timelines are estimates and not guaranteed.
  • You must inspect shipment upon delivery and report any visible damage within 48 hours with photos.
  • Failure to provide timely notice may limit or void damage claims.

4. Returns, Cancellations & Custom Products

Unless stated otherwise:

  • Custom, built-to-order, or size-specified products are final sale, non-returnable, and cannot be cancelled once production begins.
  • Returned items must be in new/unused condition in original packaging and may be subject to restocking fees and return shipping costs.

Brand-specific policies may override this section and will be listed on individual product pages.

5. Product Safety, Use & Assumption of Risk

Golf simulation involves high-speed ball impact and inherent risk of injury.

By purchasing, you agree and acknowledge:

  • You are solely responsible for correct setup, installation, and safe use of products.
  • You will inspect the product before use and immediately cease use if any defect or hazard is identified.
  • You assume all risks associated with golf activities and indoor use, including but limited to, ball ricochet, mishits, personal injury and act of god.
  • You are responsible for ensuring adequate space, safety clearance, and protective accessories (e.g., net walls, foam inserts, ceiling baffles).
  • We strongly recommend use of safety eyewear and strict supervision of non-players.

6. Installation Disclaimer

We do not provide installation services.
Any installation performed by you or a third party is not our responsibility.

We are not liable for:

  • Incorrect or unsafe installation
  • Property damage during installation
  • Inaccurate room measurements or poor site readiness

7. Manufacturer Warranty

All warranties are provided exclusively by the manufacturer unless stated otherwise.

We:

  • Make no independent warranties
  • Are not responsible for warranty-based replacements or repairs
  • Will assist in facilitating warranty claims when applicable

Warranty terms are located on each product page or at the manufacturer’s website.

8. Disclaimer of Warranties

Except for manufacturer warranties:

All products are sold “AS IS” without warranties of any kind.

To the maximum extent permitted by law, we disclaim all:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement

Some states do not allow this disclaimer — in such cases, it applies only to the extent allowed.

9. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, special, incidental, punitive, or consequential damages, including injury, property damage, or lost profits.
  • Our maximum aggregate liability is limited to the purchase price paid for the product giving rise to the claim.

This limitation remains in force even if advised of the possibility of such damages.

This limitation does not apply to death or bodily injury caused by our gross negligence or intentional misconduct, where prohibited by law.

10. Governing Law & Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute must be resolved exclusively in the state or federal courts located in Texas, and you consent to such jurisdiction and venue.

11. Changes to Terms

We may update these Terms at any time. The updated “Last Updated” date indicates when changes take effect. Your continued use of the Site following changes constitutes acceptance.
